Ancora divieti…siamo criminali !

siamo una coppia italo-tedesca, turisti in viaggio nel Vostro Paese e arrivando ad Aguilas abbiamo trovato una sgradevole sorpresa.

Sono apparsi molti cartelli di divieto sosta per camper, che gli anni scorsi non c‘ erano.

Riportano di una Legge del 1985 che di fatto vieta il campeggio libero al di fuori dei camping.

Dico subito che ogni Paese ha le sue Leggi e che vanno rispettate, ma questo non mi impedisce di fare dei commenti e porre delle domande.

Questa Legge, vecchia di 33 anni, nelle intenzioni del legislatore, doveva impedire di porre tende ovunque e arginare il problema degli zingari con le roulotte (spesso mendicanti e ladri). Tutto questo giustissimo per ovvi motivi igienici e di ordine pubblico.

Ma fino ad ora questa Legge non era realmente applicata agli autocaran, se non per gravi motivi.

In questi 33 anni è sorto il „fenomeno autocaravan“. Questi mezzi sono oggi diffusissimi e sono dotati di tutti i requisiti per rispettare l‘ ambiente (WC, doccia, serbatoi di recupero acque sporche da svuotare nelle apposite aree).

Lo stesso Ministero dell‘ Interno Direccion General Trafico, ne riconosce la legittimità e ne regola la sosta, in pratica „aparcar-no acampar“. Questa „Instruccion“ del 2008 è molto chiara in materia e rende uguali le autocaravan alle auto. Anche se con qualche idea incomprensibile; ad esempio 2 sedie fuori dal camper non sono ammesse, ma se le stesse le porti in spiaggia, è tutto regolare !!!!

Di solito non siamo giovani irresponsabili, ma turisti anziani e spesso ripuliamo il posto dove ci fermiamo da lattine e bottiglie di birra abbandonate da coppie di giovani locali che si appartano.

E questi turisti non vogliono utilizzare „camping-prigione“.

Non comprano mezzi che costano quasi come un appartamento per usare squallide AreeSosta recintate da filo spinato.

Vogliono godere le bellezze del vostro Paese, senza essere criminalizzati per questo e minacciati di multa da 1.000 euro.

 

Vicino alla vostra città ci sono 2 aree naturali bellissime, dove sostano abitualmente circa 70-80 camper.

In pieno rispetto dell‘ ambiente. Facciamo due conti:

ogni camper spende in media non meno di 1000 (mille) euro al mese (supermarket, negozi, farmacie, tabacchi, souvenir, ristoranti e bar, diesel e gas etc) che in un anno significano quasi 1.000.000 (unmilione) euro.

Di questi circa 190.000 di Iva e tasse varie.

E questo solo per 2 Aree solitamente frequentate. A voi fare i conti per le migliaia di Autocaravana in giro per la Spagna.

Prima domanda: Pensate che questi soldi che portiamo siano superflui per la vostra economia?

Persino 2 panetterie locali non la pensano così, in quanto ogni mattina ci forniscono „a domicilio“ pane fresco.

Seconda domanda: perchè citare nei cartelli di divieto solo la Legge del 1985 e non quella più recente 2008 sopra citata, che regola „aparcar-no acampar“ per le autocaravan? Forse i Suoi consiglieri legali non sono aggiornati.

Le Leggi vanno tutte rispettate, dai turisti ma anche dagli Amministratori e Forze dell‘ ordine.

Non lo pretendo, ma spero che meditiate su tutto ciò e sarebbe gradita una Sua risposta.

Dear Mrs. Mayor of Aguilas (Murcia-Spain), (english version)

we are a Italien-german couple, tourist travelling in Your Country and arriving in Aguilas we found an unpleasant surprise.

A lot of notice „no parking for autocaravan“, that years before were not.

According to a Law of 1985, telling that free camping is forbidden out of the camping-site.

I want to tell you, first of all, that every Country have Law and have to be respected, but let me give some comment and give you some questions.

This Law, 33 years old., from lawgiver in order to prevent to put allover tents and stop some problem coming from gipsy with roulotte (often begging and burglaring). All that is right for hygienic reason and to prevent crime.

But, until now, this Law was not really used against autocaravan, if there were not serious causes.

In these 33 years born the „autocaran fenomena“. Autocaravan and motorhome are today so diffused and have all the tools inside to respect environment (WC, shower, tank to hold used water that have to discharge in special area).

Your Ministerio del Interior Direccion General Trafico wrote the lawfulness and the rules to park ( „aparcar-no acampar“). This „Instruccion“ of 2008 is very clear in this argoument and make equal autocaravan and car. Sometime has some incomprehensible idea, like 2 chairs out of the autocaravan are not allowed, but if you park and bring the same chairs on beach, is right !!!

Usually we are not young irresponsible people, but old tourists (in pension) and often we are cleaning where we park from cans or beer bottles left from young couple with cars.

A lot of these people travelling by autocaravan don’t agree and want to use „camping site-prison“.

A lot of these people don’t buy autocaravan, that sometime have a price like a little flat, to use wretched Areas enclosed by barbed wire.

They want to enjoy the beauty of Your Country without to appear criminal to punish 1.000 euro fine.

 

Near Your town there are 2 natural wonderful areas, where usually are parking 70-80 autocaravans.

Total respectful of environment. Let me make a little computation:

Every autocaravan spend, on the average, not less than 1.000 (onethousand) euro per mounth (supermarket, shops, farmacy, tobacco, restaurant and bar, diesel and gas etc.) that in 1 year means

roughly 1.000.000 (one milion) of euro.

Frome these 190.000 euro of VAT and various local tax.

All that only from 2 free-areas. I let you make the computation for thousands of foreign autocaravan around Spain.

 

First question: Do you think this money is superfluous or unnecessary for Your economy ?

Even 2 local bakers are thinking the opposite; every morning they give us „at home“ fresh bread. Also a restaurant give a Shuttle-Service to take and bring back from Campers to the Campers!

Second question: why to cite to support your arguments the Law of 1985 and not one more update of 2008 (look attachment), that give the rules „aparcar-no acampar“ for autocaravans?

PerhapsYour legal adviser are not up date.

The Law have all to be respected, from tourist but also from Administrator and Police.

I don’t claim, but I hope that You think about and should be nice a answer from You.

Sehr geehrte Frau Bürgermeisterin von Aguilas (Murcia-Spanien), (deutsche Version)

Wir sind ein italienisch-deutsches Paar, Touristen, die in Ihrem Land reisen und in Aguilas ankommen. Wir haben leider eine unangenehme Überraschung gefunden.

Eine Menge Hinweisschilder „kein Parkplatz für Autocaravan“, die Jahre zuvor nicht waren.

Gemäß einem Gesetz von 1985, dass freies Campen außerhalb des Campingplatzes verboten ist.

Ich möchte Ihnen zunächst versichern, dass jedes Land Gesetze hat und diese respektiert werden wollen, aber lassen Sie mich dazu etwas schreiben und Ihnen einige Fragen stellen.

Dieses Gesetz ist 33 Jahre alt, vom Gesetzgeber, um zu verhindern, dass man überall Zelte aufstellen kann, was häufig ein Problem von Zigeunern ist (oft mit Wohnwagen – welche oft betteln und stehlen). Das ist alles aus hygienischen Gründen und um Verbrechen zu verhindern.

Aber bis jetzt wurde dieses Gesetz nicht wirklich gegen Wohnmobile angewandt, weil es keine ernsten Gründe gab.

In diesen 33 Jahren wurden die „autcaran fenomena“ geboren. Autocaravans und Wohnmobile sind heute so verbreitet und beinhalten alles, um die Umwelt zu respektieren (WC, Dusche, Behälter, um gebrauchtes Wasser zu halten, das in speziellem Gebiet entladen werden muss).

Ihr Ministerio del Interior Direccion General Trafico schrieb die Rechtmäßigkeit und die Regeln für den Park („aparcar-no acampar“). Diese „Instruktion“ von 2008 ist sehr klar in dieser Argumentation und macht Autocaravan und Auto gleich. Irgendwann hat man eine unverständliche Idee, wie 2 Stühle aus dem Wohnmobil sind nicht erlaubt, aber wenn Sie parken und bringen Sie die gleichen Stühle am Strand, ist das richtig !!!

Gewöhnlich sind wir keine jungen unverantwortlichen Leute, sondern alte Touristen (in der Pension), die oft reinigen, wo wir achtolos weggeworfene Dosen oder Bierflaschen vorfinden, die von jungen Paaren mit Autos achtlos weg geworfen werden.

Viele der Wohnmobilfahrer sind nicht einverstanden und wollen kein „Campingplatz-Gefängnis“ benutzen.

Viele dieser Leute kaufen keine Wohnmobile, die manchmal einen Preis wie eine kleine Wohnung haben, um erbärmliche Gebiete zu benutzen, die von Stacheldraht umschlossen sind.

Sie wollen die Schönheit Ihres Landes genießen, ohne kriminell zu wirken und 1.000 Euro Strafe zu bestrafen.

 

In der Nähe Ihrer Stadt gibt es 2 wunderschöne Naturgebiete, in denen rund 70-80 Wohnmobile stehen.

Absolut respektvoll gegenüber der Umwelt. Lass mich eine kleine Rechnung machen:

Jedes Wohnmobil gibt im Durchschnitt rund 1.000 (tausend) Euro pro Monat aus (Supermarkt, Geschäfte, Apotheke, Tabak, Restaurant, Bar, Diesel und Gas usw.), was in einem Jahr bedeutet ungefähr 1.000.000 (eine Million) Euro.

190.000 Euro Mehrwertsteuer und verschiedene lokale Steuern.

All das nur von 2 Freiflächen. Ich lasse Sie die Berechnung für tausende von ausländischen Wohnmobilen in Spanien machen.

 

Erste Frage: Denken Sie, dass dieses Geld für Ihre Wirtschaft überflüssig oder unnötig ist?

Sogar 2 lokale Bäcker denken das Gegenteil; Jeden Morgen geben sie uns „zu Hause“ frisches Brot. Auch ein Restaurant bietet einen Abhol- und Bringdienst an für die Camper!

Zweite Frage: Warum zu zitieren Sie das Gesetz von 1985 und nicht eine weitere Aktualisierung vom Jahr 2008? (siehe Anhang), das die Regeln „aparcar-no acampar“ für Wohnmobile gegenüber einem PKW gleichstellt?

Vielleicht sind Ihre Rechtsberater nicht auf dem neuesten Stand.

Das Gesetz muss respektiert werden, vom Touristen aber auch vom Administrator und der Polizei.

Ich glaube nicht, aber ich hoffe, dass Sie darüber nachdenken und ich eine Antwort von Ihnen erhalte.
